Australian Skilled Visas

Looking to live and work in Australia? As a qualified professional or tradesperson with relevant work experience, you may be eligible to apply for an Australian Skilled Visa.

The General Skilled Australian Migration program is for people who are not sponsored by an employer (have a job offer from an Australian company). Applicants must be over 18 and under 45 years of age, with good English language ability, recent relevant skilled work experience and qualifications that are equivalent to Australian standard.

There are three categories of skilled visa as set out below which have the following basic requirements. You must;

  • be under 45 years of age
  • nominate an occupation on the appropriate skills list
  • meet the relevant English language criteria
  • meet Australia’s health requirement
  • meet the legislated points score

The following Australian skilled visas are available to individuals who are qualified to work or train in an eligible skilled occupation in Australia and can meet all other requirements:

  • Employer Nomination Scheme (ENS) visa (subclass 186)
  • Regional Sponsored Migration Scheme (RSMS) visa (subclass 187)*
  • Skilled Independent visa (subclass 189)
  • Skilled Nominated visa (subclass 190)
  • Training visa (subclass 407)
  • Temporary Skill Shortage (TSS) visa (subclass 482)
  • Temporary Graduate visa (subclass 485)
  • Skilled Regional (Provisional) visa (subclass 489).

Migrate 2 Oz focuses primarily on Australian skilled visas which provide immediate permanent residence (subclass 189, subclass 190) or a secure pathway to obtain permanent residence (subclass 489).

Skilled Independent Visa (Subclass 189)

What is a Skilled Independent Visa? (Subclass 189)

The Subclass 189 Skilled Independent Visa gives permanent residency to points-tested skilled individuals who are not sponsored by an employer or family member or nominated by an Australian state or territory.

What does "skilled independent" mean?

This visa does not rely on sponsorship by a company, family member or state in Australia – hence it is called “skilled independent". It relies solely on the applicant’s qualifications and experience.

Should you qualify for a skilled independent visa, you will have the same privileges as an Australian citizen except;

  • you cannot vote in Government elections.
  • you will not qualify for any social security benefits for the first two years after your arrival to settle in Australia.
  • The applicant is not sponsored by an employer, family member or nominated by an Australian state.
  • The applicant must be under 45 years of age.
  • The applicant must obtain suitable skills assessment for their occupation.
  • The applicant must achieve a passing score set by the points test.
  • The applicant must meet the relevant English language criteria.
  • Stay, work and study in Australia permanently.
  • Enroll in Medicare, Australia’s scheme for health-related care and expenses.
  • Apply for Australian citizenship (when you are eligible).
  • Sponsor eligible relatives for permanent residence.
  • Travel to and from Australia for five years from the date the visa is granted, unless you become an Australian citizen.

You must meet certain health requirements which will depend on personal circumstances e.g. time spent in another country during the last five years, country of citizenship and intended activities in Australia.

Health examinations are valid for 12 months.

You must meet certain character requirements. You must provide a police certificate from each country you have lived in for 12 months or more during the past 10 years after you turned 16 years of age.

You can include the following people in your visa application:

  • your partner (married or de facto)
  • yours or your partner’s dependent children
  • other dependent relatives.

Skilled Nominated Visa (Subclass 190)

What is a Skilled Nominated Visa? (Subclass 190)

The Subclass 190 Skilled Nominated Visa gives permanent residency to points-tested skilled individuals who have been nominated by an Australian state or territory government agency to live and work in Australia.

What does "nominated" mean?

Each state or territory has a list of occupations in demand. You can apply to be sponsored in just one state or territory or you can choose to apply to all of them.

Should you accept nomination you may be required to:

  • live in the sponsored state or territory for a specified amount of time.
  • advise the state or territory of your address, both before and after your arrival in Australia.
  • be prepared to complete surveys and provide other post-arrival information as requested.
  • meet any other stipulated requirements.
  • The applicant must have been nominated by an Australian state or territory government agency.
  • The applicant must be under 45 years of age.
  • The applicant must obtain suitable skills assessment for their occupation.
  • The applicant must achieve a passing score set by the points test.
  • The applicant must meet the relevant English language criteria.
  • Stay, work and study in Australia permanently.

Skilled Regional (Provisional) Visa (Subclass 489)

What is a Skilled Regional (Provisional) Visa? (Subclass 489)

This visa allows skilled workers to live and work in a specified regional area of Australia for up to four years. If you are eligible, this visa provides a pathway to permanent residence through the Skilled-Regional (Residence) Visa (Subclass 887).

In order to be eligible under the invited pathway, you must;

  • be nominated by an Australian State or Territory.
  • nominate an occupation on the appropriate skills list and have a suitable skills assessment for that occupation.
  • be under 45 years of age.
  • achieve the required points score based on the factors in the points test.

What does this visa allow you to do?

  • stay in Australia for up to four years.
  • live, work and study in a specified regional area of Australia.
  • travel in and out of Australia while the visa is valid.
  • this visa provides a pathway to permanent residence through the Skilled-Regional (Residence) Visa (Subclass 887).

Your obligations under the 489 visa class.

You must live, study and work in a regional and low population-growth metropolitan area and comply with any residential conditions specified by the State or Territory government who sponsor you.

When you later apply for permanent residence, you will need to prove that you have spent the specified time in a regional and low population growth metropolitan area.

Securing Sponsorship

State and Territory government agencies decide whether to nominate you for this visa based upon their respective skills list that guide the types of skills they are looking for.

If you accept a sponsorship, the State or Territory might require you to:

  • live in the nominating State or Territory for at least two years.
  • advise the State or Territory of your address both before and after you arrive in Australia.
  • complete surveys and provide information as requested.
  • meet any other stipulated requirements.

NOTE: Each State or Territory government agency has its own process for sponsoring suitable applicants.

To sponsor you, your relative must be at least 18 years of age and live in a designated area of Australian as an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen.

Your relative can be a:

  • child or step-child.
  • parent or step-parent
  • brother.sister, adoptive brother, adoptive sister, step brother, step sister, niece, nephew, adoptive niece, adoptive nephew, step-niece, step-nephew, aunt, uncle, adoptive aunt, adoptive uncle.
  • grandparent or first cousin.

Your sponsor is required to provide certain documents to support their undertakings and obligations to support you and help you settle in Australia.
